Welcome to ON9Tour.com. By making a reservation through our website, email, telephone, or any other method, you are considered to have read, understood, and agreed to be bound by these Terms and Conditions unconditionally.
1. GENERAL AGREEMENT
1.1. The agreement between the Customer and ON9Tour.com comes into force as soon as the Company provides the Customer with the Booking Confirmation or an Invoice by email.
1.2. No person other than ON9Tour.com in writing has the authority to vary, add, amplify or waive any description, representation, term or condition set forth.
1.3. All terms and conditions are subject to change without prior notice.
1.4. All customers who make a reservation through any method are considered to agree to these terms and conditions.
2. TOUR DEPOSIT AND PAYMENT
2.1. Inbound Tours: A maximum deposit of 50 percent of the tour fare per person is required as a reservation fee. The balance or full payment must be settled within 30 days before the departure date.
2.2. Outbound Tours: A maximum deposit of 25 percent of the tour fare per person is required. Balance or full payment must be made within 14 days before departure for FIT Free Independent Traveller packages or 21 days before departure for GIT Group Tour packages or Group Trip Departures.
2.3. Travel Fairs: Deposit amounts may vary and are typically higher or subject to special rules during events like MATTA Fair or other travel exhibitions.
2.4. Failure to Comply: Failure to settle payments within the stipulated timeframe may result in the automatic cancellation of the reservation and forfeiture of the deposit.
2.5. Tour Type: All tours are Ground Arrangement Private Tour unless explicitly stated as Group Tour, Group Trip Departure, or Seat In Coach SIC.
3. AMENDMENT CHARGES
3.1. FIT Tour Packages: Any changes made after confirmation are subject to an amendment charge of RM50.00 per person per change. No changes are allowed within 8 working days before departure. Changing the entire reservation constitutes a cancellation and is subject to cancellation charges.
3.2. Group Tour Packages GIT: No changes are allowed within 14 days before departure. Any request to return earlier or later than the group is subject to the conditions and charges of the respective airlines.
4. CANCELLATION CHARGES BY TOUR MEMBER
4.1. All cancellations must be made in writing to avoid misunderstanding.
4.2. FIT Outbound: If cancelled 30 days or more before departure, a minimum administrative fee of RM50.00 or 10 percent of the deposit whichever is lower will be charged.
4.3. FIT Inbound: All deposits are non refundable subject to hotel or supplier terms.
4.4. FIT Inbound Tiered Charges: 30 working days or more is 50 percent of tour fare. 29 working days or less is 100 percent of tour fare.
4.5. FIT Outbound Tiered Charges: 15 to 19 working days is 50 percent of tour fare. 8 to 14 working days is 20 percent of tour fare plus specific supplier costs. 3 to 7 working days is 40 percent of tour fare. 2 working days or less is 100 percent of tour fare.
4.6. Group Tour Packages GIT Outbound: If cancelled 45 working days or more before departure, an admin fee of RM30.00 or 2 percent of tour fare whichever is higher applies.
4.7. Travel Fair Bookings: Deposits paid during Travel or Trade Fairs are strictly non refundable.
4.8. Group Tour Packages GIT Tiered Charges: 22 to 44 working days is forfeiture of tour deposit. 15 to 21 working days is 35 percent of tour fare. 8 to 14 working days is 50 percent of tour fare. 3 to 7 working days is 75 percent of tour fare. 2 working days or less is 100 percent of tour fare.
5. CANCELLATION BY COMPANY
5.1. The Company reserves the right to cancel a tour due to Force Majeure such as Act of God, war, strike, riot, or government orders.
5.2. In the event of insufficient passengers or inability to secure seats, the company will offer an alternative or a full refund plus compensation.
5.3. Compensation Scale: 8 to 14 working days before departure is Full refund plus RM50 compensation. 1 to 7 working days before departure is Full refund plus RM75 compensation. On date of departure is Full refund plus RM100 compensation.
6. TRAVEL DOCUMENTS AND VISAS
6.1. Member Responsibility: Must possess a valid passport with minimum 6 months validity, necessary visas, and health or vaccination certificates.
6.2. Visa Rejection: If a visa application is rejected, a refund of the tour fare will be made less administrative fees.
6.3. Refusal of Entry: The company is not liable for expenses or refunds if a member is deported or refused entry by immigration due to unlawful items, improper documents, or behavior.
7. TOUR PRICES AND INCLUSIONS
7.1. Prices are subject to change due to airfare increases, currency fluctuations, or government taxes.
7.2. Inclusions: Return air ticket excluding taxes unless stated, accommodation based on Twin, Triple, or Single supplement, meals, and sightseeing as per itinerary.
7.3. Exclusions: Laundry, personal food or beverages, optional excursions, porterage, and items of a personal nature.
8. UNUSED SERVICES AND BAGGAGE
8.1. No Refund: No refund will be provided for any unused services such as meals or transport due to personal reasons once the tour has commenced.
8.2. Baggage: Members must follow airline baggage allowances. We highly recommend purchasing Travel Insurance for baggage loss.
9. POSSIBLE CHANGES AND RIGHTS
9.1. Itinerary Changes: The Company reserves the right to alter itineraries or hotels if necessary due to local conditions or airline schedules.
9.2. Right to Reject: We reserve the right to cancel or decline any person whose conduct is deemed offensive or a danger to others. In such cases, liability is limited to a refund of money paid less services used and admin fees.
10. RESPONSIBILITY AND LIABILITY
10.1. Agency Role: ON9Tour.com acts as an agent for transportation companies, hotels, and contractors. We assume no responsibility for injury, damage, accident, loss, or delay caused by these third party providers.
10.2. Compensation: Compensation for service failures will be determined based on the guidelines of the Commissioner of Tourism.
11. TRAVEL INSURANCE
11.1. All tour members are strongly encouraged to purchase travel insurance to protect against sickness, cancellations, flight delays, or loss of baggage.
12. ONLINE BOOKING AND PRICING ACCURACY
12.1. Data Entry: Customers are fully responsible for the accuracy of information entered during online booking including name spelling as per passport, date of birth, and contact details. Any amendment costs due to input errors will be borne by the customer.
12.2. Pricing Errors: While we strive to ensure prices on the website are updated, in the event of a technical error in the pricing system, ON9Tour.com reserves the right to cancel the reservation.
12.3. Availability: Booking confirmation is subject to room or hotel and flight seat availability at the time the transaction is processed.
13. PAYMENT GATEWAY AND TRANSACTION FEES
13.1. Methods: We accept payments through bank transfer FPX, credit or debit cards, and e wallets through authorized third party payment gateways.
13.2. Surcharges: Any additional charges imposed by the bank or credit card provider are the responsibility of the customer.
13.3. Security: ON9Tour.com does not store your credit card information. All transactions are processed through an encrypted Secure Sockets Layer SSL connection.
14. PRIVACY POLICY AND DATA PROTECTION PDPA
14.1. Consent: By making a booking, customers give consent to ON9Tour.com to collect and process personal data for travel purposes in accordance with the Personal Data Protection Act 2010 PDPA.
14.2. Usage: Your data will not be sold to third parties for marketing purposes without your consent.
15. SPECIAL REQUESTS
15.1. Preferences: Special requests such as Halal or Vegetarian food, nearby rooms, or baby cots are subject to availability by service providers and are not 100 percent guaranteed.
16. FORCE MAJEURE AND UNFORESEEN CIRCUMSTANCES
16.1. Scope: ON9Tour.com will not be responsible for any failure to perform the contract caused by circumstances beyond control including but not limited to pandemics, outbreaks, natural disasters, government travel restrictions, border closures, war, or riots.
16.2. Immediate Cancellation: The Company reserves the right to cancel or terminate any tour without prior notice if an unforeseen event such as war or a medical outbreak occurs that endangers the safety of tour members.
16.3. Liability: In such cases of sudden termination, all additional costs including emergency flights, accommodation, and medical expenses are the sole responsibility of the customer.
16.4. Refunds under Force Majeure: Refunds are subject to the refund policy of third party suppliers. Administrative charges may still be applied by the company.
17. CUSTOMER BEHAVIOR AND INDEMNITY
17.1. Conduct: Customers agree to comply with the laws of the country visited. Any legal action or costs arising from customer misconduct are the full responsibility of the customer.
17.2. Indemnity: Customers agree to release ON9Tour.com from any claims of liability or loss arising from the customer own negligence during the tour period.
18. PROOF OF VACCINATION AND HEALTH PROTOCOLS
18.1. Compliance: Tour members are responsible for complying with all health protocols, vaccination requirements, and medical regulations of the destination country.
18.2. Documentation: The Company is not responsible for any tour member being denied boarding or entry due to failure to provide valid health certificates.
19. PHOTOGRAPHY AND VIDEOGRAPHY
19.1. Consent for Media: During the tour, the Company or its representatives may take photographs or videos for promotional and marketing purposes.
19.2. Opt out: By joining the tour, members grant the Company permission to use such media. Members who do not wish to be featured must inform the Tour Leader or Guide explicitly at the start of the trip.
20. CURRENCY AND EXCHANGE RATES
20.1. Price Basis: All prices are quoted in Malaysian Ringgit MYR unless stated otherwise.
20.2. Adjustments: For outbound tours, the final price is subject to adjustment based on the prevailing exchange rate if there is a significant fluctuation of more than 3 percent before final payment.
21. WEBSITE AVAILABILITY AND ERRORS
21.1. Technical Issues: The Company does not guarantee that the website ON9Tour.com will be error free or uninterrupted.
21.2. Information Accuracy: While we strive for accuracy, descriptions and images on the website are for illustration purposes only. Actual services may vary slightly.
22. COMPLAINTS AND DISPUTE RESOLUTION
22.1. On site Reporting: Any complaints regarding the service must be reported to the local guide or hotel management immediately to allow for rectification on the spot.
22.2. Formal Complaint: If the issue remains unresolved, a formal written complaint must be submitted to ON9Tour.com within 14 days after the completion of the tour.
22.3. Jurisdiction: These terms are governed by the laws of Malaysia and any disputes shall be referred to the exclusive jurisdiction of the Malaysian Courts.
23. EMERGENCY SITUATIONS DURING TOUR
23.1. Termination without Notice: Should any undesirable event occur such as war, civil unrest, or a widespread medical epidemic while the tour is in progress, the Company reserves the right to cancel the remaining itinerary immediately without prior notice.
23.2. Customer Responsibility: All costs arising from such emergency terminations including rearranged transportation and temporary lodging are the sole responsibility of the customer.
24. FLIGHT TIMES AND SCHEDULES
24.1. Schedule Changes: Flight timings and itineraries are subject to change by the airlines without prior notice. The Company is not responsible for any losses or expenses incurred due to flight delays or rescheduling.
24.2. Seat Allocation: Seat assignments on any aircraft are at the sole discretion of the airline.
25. CHILD POLICY
25.1. Definition: A child fare is only applicable for children aged 2 years but not more than 12 years of age at the time of departure. Infants are defined as those below 24 months of age.
25.2. Verification: The Company reserves the right to request proof of age. Any discrepancies in age that result in additional charges shall be the sole responsibility of the customer.
26. OWNERSHIP OF COPYRIGHT
26.1. The copyright in this website and the material on this website including without limitation the text, computer code, artwork, photographs, images, music, audio material, video material and audio visual material on this website is owned by ON9Tour.com and its licensors.
26.2. All rights reserved. No part of this website may be reproduced, distributed, or transmitted in any form or by any means, including photocopying, recording, or other electronic or mechanical methods, without the prior written permission of the owner.
27. COPYRIGHT LICENSE
27.1. ON9Tour.com grants to you a worldwide non exclusive royalty free revocable license to view this website and the material on this website on a computer or mobile device via a web browser.
27.2. You may copy and store this website and the material on this website in your web browser cache memory and print pages from this website for your own personal and non commercial use.

31.1. If you become aware of any material on the website that you believe infringes your or any other persons copyright, please report this by email to the customer service team.
32. ATTRIBUTION
32.1. Certain images or icons used on this website may be the property of third party providers or licensors and are used under appropriate licensing agreements.
32.2. Any unauthorized use of these third party materials is also strictly prohibited.
